Maneki.lt website and application Terms of Service

These, Maneki.lt website and application terms of Service (hereinafter – “Terms”) regulate the legal relationship between VšĮ Maneki LT, Reg. No: 305524497, Saulėtekio al. 15, LT - 10224, Vilnius, Lithuania established in accordance with the laws of the Republic of Lithuania (hereinafter – Maneki), and the person who decided to become Maneki.lt website and application volunteer.

Definitions

1.1. Maneki platform – is a Maneki managed website available at www.maneki.lt and mobile application intended for the use with smartphones or other devices, available at www.maneki.lt or on other mobile application distribution channels, such as Google Play Store.

1.2. Volunteer – a person of or over the age of 16 years old who has registered on Maneki platform and his/her Maneki volunteer status has been approved by Maneki.

1.3. Applicant – a person, who has indicated that he/she needs assistance from volunteers and has defined his/her nature of request to a Partner and about which such Partner has notified Maneki.

1.4. Partner – an NGO that identifies, collects and validates required information about Applicant and his/her Request and conveys this information to Maneki platform.

1.5. Request – a specific request, conveyed and validated by a Partner, which consists of information about the nature of the request, the Applicant and the location of the task and the desired time.

Registration and use of the Maneki platform

2.1. Volunteer registered in the Maneki platform expresses his/her consent to accept the rights and obligations outlined in the Terms. The volunteer is also subject to the rights and obligations set out in the Privacy Policy.

2.2. Maneki reserves the right, in its sole discretion, to decline the registration of any registering person.

2.3. The Volunteer in the Maneki platform has the right to approve the type and nature of the Requests that they would like to help Applicants fulfil.

2.4. A person registered in the Maneki platform and approved by Maneki acquires Volunteer status. The Volunteer has the right to fulfil Requests in accordance with the Terms.

Rights and obligations

3.1. Volunteer undertakes:

3.1.1. To provide only correct, realistic data when registering and to inform Maneki of any changes to this data.

3.1.2. When fulfilling Applicant Requests, volunteer undertakes to comply with the laws and legislation of the Republic of Lithuania, including, but not limited to, decrees of the Government of the Republic of Lithuania implemented during the fight against COVID-19.

3.1.3. To fulfil Requests free of charge, in an orderly, fair and timely manner.

3.1.4. To accept only those Requests that he/she has sufficient competence and conditions to fulfil.

3.1.5. To cooperate with Maneki and prove the completion of Request in a chosen method and to mark changed Request status on Maneki platform.

3.1.6. To inform Maneki in advance if Volunteer can no longer fulfil Request due to changed circumstances.

3.1.7. Not to use the received information about Applicant and/or Request for purposes other than those specified on the Maneki platform and not to pass on such information to third parties.

3.2. Maneki undertakes:

3.2.1. To inform the Volunteer and provide accurate information about the nature of the Request, the desired time and location of fulfilment.

3.2.2. To inform the Volunteer as much as possible about planned Maneki platform disruptions.

3.2.3. To cooperate with the Volunteer, to help him/her solve the issues arising during the execution of the Requests (if possible) and to mediate between the Volunteer and the Partner if necessary.

Validity of the terms

4.1. The terms between Maneki and the Volunteer are valid from Volunteer status acquisition until one of the parties decides to terminate the cooperation.

4.2. Maneki has the right to unilaterally refuse the Volunteer’s application and to terminate the Volunteer account on Maneki platform, stating the reasons for the refusal.

4.3. Volunteer has the right to unilaterally withdraw from the Maneki platform and refuse the Volunteer status by deleting his/her account on Maneki platform and informing Maneki thereof.

Confidentiality

5.1. All information received, which is provided by Maneki or Partners, during the course of or as a result of participation on the Maneki platform, is considered confidential.

5.2. In carrying out the volunteering functions specified in the Terms of the Maneki platform, the Volunteer undertakes to use confidential information only for the fulfilment of the selected Requests.

5.3. The Volunteer undertakes not to disclose or transfer confidential information to third parties without Maneki's prior consent.

Final provisions

6.1. All disputes between the Volunteer and Maneki shall be resolved in accordance with the laws of the Republic of Lithuania.

6.2 Maneki reserves the right to change the Terms in advance at its discretion, but no later than informing the volunteer 7 days prior about the changes of Terms, on the Maneki platform or by Volunteer's e-mail.
